Lavana Design LLC Purchasing Terms and Conditions 

Your execution of the Sales Quote and/or purchase of  Lavana Design product  indicates that you agree to the terms and conditions of the following Purchasing Agreement: 

MINIMUM WHOLESALE ORDER REQUIREMENTS 

Minimum initial order 50 units (Hard Hat Hut)

Minimum re-order 25 units (Hard Hat Hut)

INTELLECTUAL PROPERTY

Customer acknowledges that the name “Hard Hat Hut," all text and graphics on Hard Hat Hut web pages, and all photographs of Lavana Design modeled items are the exclusive intellectual property of Lavana Design. Permission is granted to Resellers to Hard Hat Hut photographs, graphics and text solely in connection with the retailing of Lavana Design products and only when there is clear attribution to Lavana Design.

PAYMENT METHODS

Payment is due in full once order is delivered. Invoice will be provided upon delivery. Payment can be made online or via Check. Invoices must be paid within 48 hours of receipt. 

Net 30 terms can be established after initial order is completed

SHIPPING/HANDLING Items will be delivered FOB Destination

SHIPPING ERRORS, RETURNS, AND WARRANTY 

Order errors must be brought to the attention of Lavana Design within 7 business days of receipt of shipment. Returns may only be requested due to defects or flaws. Any returns requested after the 7 day window will not be accepted.

MERCHANTABILITY AND MISREPRESENTATIONS 

Customer agrees that Lavana Design is not liable for any misuse or misrepresentations of the goods by the customer or the final retail purchaser or consumer, and indemnifies Lavana Design for any legal actions that emanate from such actions.

LIMITATION OF LIABILITY

You understand and agree that Lavana Design and any of its subsidiaries or affiliates shall in no event be liable for any direct, indirect, incidental, consequential, or exemplary damages. This shall include, but not be limited to damages for loss of profits, business interruption, business reputation or goodwill, loss of programs or information or other intangible loss arising out of the use of or the inability to use the service, or information, or any permanent or temporary cessation of such service or access to information, or the deletion or corruption of any content or information, or the failure to store any content or information. The above limitation shall apply whether or not Lavana Design has been advised of or should have been aware of the possibility of such damages. In jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not allowed the liability of Lavana Design is limited to the greatest extent permitted by law.
